Brasília – The Italian Foreign Minister, Franco Frattini, has told a local newspaper, Corriere Della Serra, that his country may appeal the Battisti case to the International Court in The Hague. However, in Brazil, the lawyer handling the case for the Italians, Nabor Bulhões, says any decision regarding The Hague should wait until an appeal to the Brazilian Supreme Court is judged – which will only happen at the beginning of February.
Frattini has said that the decision by Brazil to disregard the bilateral treaty on extradition is outlandish. He said the justification that Battisti’s personal safety would be at risk if he was returned to Italy was strange. “Is this some kind of a joke? With all due respect, Italy is not a country with prisoners who disappear and Italy does not torture people in its prisons,” declared the minister. He added that the decision not to extradite Battisti was an extremely grave precedent that could affect the destiny of many fugitives in the future. It could also have an adverse effect on a military agreement between Italy and Brazil, said the minister.
